Terms of Service

Last updated October 2026

These terms cover your use of phreak.space (the “Service”): file hosting, photo hosting, organization sites, chat and code repositories. By creating an account or using the Service you agree to them, to the Acceptable Use Policy and to the Privacy Policy. If you don’t agree, don’t use the Service.

Accounts

  • You must be at least 18, or the age of majority where you live, and give a working email address.
  • You are responsible for your password and for everything done through your account. Tell us if you think it has been compromised.
  • One person, one account. Don’t create accounts to dodge a ban, a limit or a review.
  • An organization owner is responsible for the organization’s members, site and content.

Plans, prices and payment

  • The Service has free and paid plans. Paid plans are subscriptions billed in advance through Stripe, monthly or for a longer term (every 3 months, every 6 months or yearly) as shown at checkout, and they renew automatically until cancelled.
  • Prices can change at any time. We will not change the price of a period you have already paid for. A new price applies from your next renewal, and you can cancel before then.
  • You can cancel at any time from your billing page. Access continues until the end of the period you paid for. Unless the law requires otherwise, payments are non-refundable, and we don’t pro-rate partial periods.
  • Taxes may be added where required. Features, limits and plan contents can change; we aim to give notice of changes that reduce what a paid plan includes.
  • If a payment fails we retry for a while. If it still fails, paid features are switched off and your content stays subject to the deletion rules below.
  • Invite codes give a time-limited trial of paid features. They have no cash value and can be withdrawn if abused.

Your content

  • You keep ownership of what you upload. You give us a limited licence to store, copy, re-encode (for example, resizing images and removing metadata), transmit and display it as needed to run the Service, including serving it to the people you choose to share it with. Content you mark public, including photos in the public feed, can be seen, downloaded and, for public safe-for-work images, hotlinked by anyone.
  • You promise you have the rights to what you upload and that it follows the Acceptable Use Policy.
  • We don’t pre-screen everything, but we may scan uploads, review reports, and remove, quarantine or restrict anything that breaks these terms or the law. We may keep evidence of illegal content and report it to authorities as the law requires.
  • Files are held for you, not backed up for you. Keep your own copies.

Copyright

We respond to valid notices under the DMCA. Send one through the takedown form. Accounts that repeatedly infringe are closed.

Suspension and termination

You can delete your account at any time. We can warn, restrict, suspend or close accounts, and remove content, if you break these terms, put the Service or other people at risk, don’t pay, or if we are required to by law. Where reasonable we will tell you why. After closure we may delete your content, and we are not required to keep it. Sections that by their nature should survive (such as payment obligations, disclaimers and limits of liability) do.

Organization sites

Organization sites are published under your organization’s address on our domain. Scripts are not allowed on them, and content is sanitised. Blocks shared with the community may be reviewed and removed. You are responsible for what your site publishes and for the messages sent through its contact form.

The Service is provided as is

We work to keep the Service running but provide it “as is” and “as available”, without warranties of any kind, to the extent the law allows. We don’t guarantee that it will be uninterrupted or error-free or that content will never be lost.

Limit of liability

To the extent the law allows, our total liability to you for any claim about the Service is limited to the amount you paid us in the 12 months before the claim (or US$50 if you paid nothing), and we are not liable for indirect or consequential losses, lost profits or lost data.

Changes to these terms

We may update these terms. We will post the new version here and, for material changes, tell you by email or on the site. If you keep using the Service after a change takes effect, you accept it.
